This Refund and Chargeback Policy ("Policy") governs the circumstances under which Sms Password Bv, a Besloten Vennootschap registered in the Netherlands under company number 62832123, with its registered office at Fellinilaan 131, Almere Stad, 1325TV, The Netherlands ("MagicPassword," "we," "us," or "our"), will provide refunds for payments made for our Services and sets forth our policies regarding chargebacks initiated by customers through their payment providers.
By subscribing to or purchasing any of our paid Services, you acknowledge that you have read, understood, and agree to be bound by this Policy, together with our Terms of Service and Privacy Policy. This Policy is incorporated by reference into our Terms of Service.
We strive to be fair and transparent in our refund practices. However, as a software-as-a-service (SaaS) provider delivering digital services, our refund options are necessarily limited to protect the integrity of our business and prevent abuse. All payments for our Services are generally final and non-refundable, except as expressly set forth in this Policy or as required by applicable law. When you purchase a subscription to our Services, you are paying for access to a digital product that is delivered immediately upon payment. Once access is granted, the service is considered consumed in whole or in part, and a refund would result in an inequitable outcome.
We offer a limited refund window for certain subscription plans, as described below, to allow new customers to evaluate the Services risk-free. Beyond this window, we do not provide refunds for partial months, unused features, downgrades, or cancellations initiated by the customer.
This Policy applies to all payment methods, including credit and debit cards, bank transfers, and third-party payment processors. Refunds, if approved, will be issued to the original payment method used for the purchase, unless otherwise agreed in writing.
We encourage all prospective customers to take advantage of our free trial or free plan, where available, before committing to a paid subscription. The free trial provides full or limited access to the Services for a specified period without charge, allowing you to evaluate whether the Services meet your needs.
At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial expires. You are responsible for canceling your subscription prior to the end of the trial if you do not wish to be charged. We do not provide refunds for charges incurred because you failed to cancel your subscription before the trial period ended.

Monthly Subscriptions. Monthly subscription fees are non-refundable. If you cancel your monthly subscription, you will continue to have access to the paid features until the end of the current billing cycle, after which your subscription will not renew. No prorated refunds will be issued for unused days within the billing cycle.
Annual Subscriptions. Annual subscription fees are generally non-refundable. However, if you are a new subscriber and request a refund within fourteen (14) days of your initial purchase, we may, at our sole discretion, issue a full refund of the annual fee, provided that you have not materially violated our Terms of Service and have not previously received a refund under this provision. This fourteen-day window is intended to allow new customers to evaluate the Services with minimal risk.
After the fourteen-day window has expired, annual subscription fees are non-refundable in their entirety, regardless of whether you cancel before the end of the annual term. By purchasing an annual subscription, you acknowledge that you are committing to a full year of service and that early cancellation does not entitle you to a refund.
Enterprise and Custom Plans. Refund terms for enterprise, custom, or negotiated plans are specified in the applicable order form, statement of work, or master service agreement. In the absence of a written agreement to the contrary, the standard refund terms set forth in this Policy apply.
Notwithstanding the foregoing, we may, in our sole discretion, grant a refund in the following circumstances: (a) a technical error on our part resulted in duplicate charges for the same billing period; (b) a technical error on our part prevented you from accessing the Services for an extended period (generally defined as more than seventy-two consecutive hours) through no fault of your own; (c) you were charged after you had already canceled your subscription and the charge occurred due to an error in our billing system; (d) you request a refund within the applicable refund window for new subscribers and meet all eligibility criteria; or (e) we determine, in our sole discretion, that exceptional circumstances warrant a refund.
Refunds granted under this section are not an admission of fault or liability and do not establish a precedent for future refund requests. Each request is evaluated on a case-by-case basis.
To request a refund, you must contact us in writing at hi@magicpassword.io within the applicable time frame, if any. Your request must include: your full name and email address associated with the account; the date of the transaction; the amount of the transaction; the reason for your refund request; and any supporting documentation (e.g., screenshots, error messages, correspondence).
We will acknowledge receipt of your refund request within five (5) business days and will endeavor to provide a decision within fifteen (15) business days. If we require additional information to evaluate your request, we will notify you promptly. Approved refunds will be processed within thirty (30) days of approval, though the timing of the credit to your account may vary depending on your payment provider and financial institution.
We reserve the right to deny any refund request that does not meet the criteria set forth in this Policy, that we reasonably suspect to be fraudulent or abusive, or that is made in bad faith.
A chargeback occurs when a customer disputes a charge with their bank, credit card issuer, or payment provider, resulting in a reversal of the transaction. While we understand that chargebacks are a legitimate consumer protection mechanism, we view the initiation of a chargeback as a serious matter and a last resort after good-faith efforts to resolve a dispute directly with us.
If you initiate a chargeback without first contacting us to attempt to resolve the issue, we reserve the right to suspend or terminate your account and restrict your future access to the Services. We also reserve the right to contest the chargeback through the applicable dispute resolution process and to provide evidence of your agreement to our Terms of Service and this Policy.
If you have a legitimate concern about a charge, we strongly encourage you to contact us at hi@magicpassword.io before initiating a chargeback. In most cases, we can resolve issues more quickly and satisfactorily through direct communication than through the chargeback process.
If a chargeback is initiated and subsequently resolved in our favor, we may charge you a dispute resolution fee to cover the administrative costs associated with responding to the chargeback, in addition to reinstating the original charge. This fee will be disclosed to you in advance and will not exceed the maximum amount permitted by applicable law.
Repeated or frivolous chargebacks may result in permanent suspension of your account and reporting to relevant fraud prevention databases and payment networks.
You may cancel your subscription at any time through your account settings or by contacting us at hi@magicpassword.io. Cancellation does not entitle you to a refund of any fees already paid, unless you qualify for a refund under the terms set forth above.
Upon cancellation, your account will remain active until the end of the current billing period, after which you will lose access to paid features. Your data will be retained in accordance with our Privacy Policy and Data Retention Schedule. If you wish to delete your data upon cancellation, you may do so through your account settings or by contacting us.
If you downgrade from a higher-tier plan to a lower-tier plan, the downgrade will take effect at the start of the next billing cycle. No partial refunds will be issued for the difference in price between the plans for the remainder of the current billing cycle.
From time to time, we may offer promotional codes, discounts, or special pricing for our Services. These promotions are subject to their own terms and conditions, which will be disclosed at the time of the offer. Unless otherwise stated, promotional pricing applies only to the initial billing period and will revert to the standard price upon renewal.
Refunds for subscriptions purchased using a promotional code or discount will be calculated based on the actual amount paid, not the standard price. If a refund is granted, any promotional value is forfeited and will not be restored or reissued.
All fees for our Services are exclusive of taxes, duties, and governmental charges, unless otherwise indicated. You are responsible for paying all applicable taxes, including value-added tax (VAT), sales tax, and use tax, in connection with your purchase. If we are required by law to collect taxes on your behalf, the applicable tax amount will be added to your invoice at checkout.
Refunds, if granted, will cover only the net amount paid for the Services, excluding any taxes, processing fees, or currency conversion fees charged by third-party payment providers. We are not responsible for any fees charged by your bank or payment provider in connection with a refund.
We may update this Refund and Chargeback Policy from time to time to reflect changes in our business practices, legal requirements, or payment processing arrangements. We will post the updated Policy on our website and update the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the revised Policy.
